National Environmental Policy Act (NEPA)

What is the National Environmental Policy Act?

The National Environmental Policy Act (NEPA) is our basic national charter for protection of the environment. It establishes policy, sets goals (section 101), and provides means (section 102) for carrying out the policy. Section 102(2) contains "action-forcing" provisions to make sure that federal agencies act according to the letter and spirit of the Act.

NEPA procedures must insure that environmental information is available to public officials and citizens before decisions are made and before actions are taken. The information must be of high quality. Accurate scientific analysis, expert agency comments, and public scrutiny are essential to implementing NEPA. Most important, NEPA documents must concentrate on the issues that are truly significant to the action in question, rather than amassing needless detail.

How Does NEPA Apply To Your Business?

Any major federal action that significantly effects that quality of the human environment requires compliance with National Environmental Policy Act (NEPA) Documentation. A federal action is defined as any action that occurs on federal properties, is accomplished by the federal government, is financed by the federal government or requires a substantive federal permit. NEPA compliance can be documented in one of three ways:

• Completion of an Environmental Impact Statement (EIS)
• Completion of an Environmental Assessment (EA)
• Completion of a Categorical Exclusion (CE)
