Conditions of Use for Electronic Data

The electronic data contained on the DuBois & King (“D&K”) website is there to facilitate the dissemination of project information. Acceptance and/or use of electronic data from D&K shall indicate an understanding and acceptance of the following terms and conditions:

The electronic data is considered part of the Instruments of Service and accurately reflects such work product at the time the files are delivered by D&K to the Initial User (i.e., the person directly acquiring the electronic data from D&K). No other representation or warranty concerning the electronic data is made by D&K and its use by any person is solely at such person’s risk and without liability or legal exposure to D&K. The user agrees to indemnify, defend, and hold harmless D&K from all claims, direct, indirect or consequential damages, losses and expenses, including attorney’s fees arising out of or resulting from the use or reuse of the electronic data. D&K makes no representations or warranties concerning the original work product on which the electronic data is based.

Without D&K’s prior written consent, the electronic data shall not be (i) modified, added to or rearranged, or (ii) used for any purpose or project other than that for which it was originally acquired by the Initial User, or (iii) provided or sold to any third party, the electronic data being solely for the use of the Initial User. D&K’s consent may be conditioned on receiving appropriate compensation and/ or assurances and indemnities.

It shall be the Initial User’s responsibility to determine the compatibility of the electronic data with the Initial User’s computer software and hardware, acceptance and/or use of the electronic data.

Addenda

Addenda will be posted to this website. It is the Bidder’s sole responsibility to check the website for addenda up to the bid due date. Addenda will not be transmitted directly to Bidders or Plan Holders, unless specific arrangements have been made.
